Who Qualifies for Special Immigrant Juvenile Status?
A child may obtain SIJ status regardless of whether they are currently a legal resident, or whether they would be inadmissible for a visa or other form of lawful immigration. This is the process through which children from foreign countries who have been brought to the U.S. in terrible circumstances can get lawful permanent residency. SIJs are never allowed to petition for a parent to come into the United States, regardless of whether that parent was abusive.
To obtain SIJ status, we must demonstrate the following:
The minor child in question must be under 21 at the time the SIJ is filed
Be physically located in the U.S
Must be unmarried
The child has been treated in such a way that qualifies as neglect, abuse, abandonment, or other severe mistreatment
Reunification with either of your parents must be impractical due to abandonment, neglect, or abuse
Remaining in the U.S. would be in the child’s best interests, and returning to their country of origin would be harmful in certain ways.
